1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the PowerHit mobile application and any related website (together, the "Service"), operated by PowerHit ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

PowerHit is an AI-powered cricket coaching application. Users upload or record video of their batting, bowling or wicket-keeping technique. The Service uses artificial intelligence to analyse body positioning and movement, generate a technique score, compare the analysis against reference footage of professional and international players, and provide personalised drills, fitness recommendations and, where available, feedback from certified human coaches.

3. Eligibility & Age Requirements

• PowerHit is intended for users aged 13 and above.
• If you are between 13 and 18 years old, you may only use the Service with the consent and involvement of a parent or legal guardian, who agrees to these Terms on your behalf and takes responsibility for your use of the Service, including any subscription charges.
• Parents and guardians are encouraged to supervise a minor's use of the Service, including video uploads and any public profile or leaderboard participation.
• We do not knowingly permit use of the Service by children under 13. If we become aware that a user under 13 has created an account, we will take steps to close that account. See our Privacy Policy for more on how we handle information relating to minors.

4. Account Registration

You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at help@powerhitapp.com if you suspect unauthorised use of your account.

5. Subscriptions & Free Trial

• Launch free trial: For a limited period following launch, new users receive full access to PowerHit's paid features at no charge, for 90 days from the date of first sign-up ("Launch Free Trial"). The Launch Free Trial is offered at our discretion and may be modified, shortened, or ended for new sign-ups at any time, without affecting users already inside their 90-day window.
• Paid plans: After the Launch Free Trial (or for any plan or feature not covered by it), continued access to premium features requires an active paid subscription, billed at the rate shown in the app at the time of purchase.
• Billing: Subscriptions are billed through the Google Play billing system (and, when available, the Apple App Store). Charges, renewal dates and cancellation are managed through your app store account settings.
• Auto-renewal: Unless cancelled before the renewal date, subscriptions renew automatically at the then-current price. You can cancel at any time through your app store subscription settings; cancellation takes effect at the end of the current billing period.
• Refunds: Refunds are handled according to Google Play (and, where applicable, Apple App Store) policies. We do not directly process refunds outside of these platforms unless required by law.

6. User Content & Video Uploads

• "User Content" means any video, image, or other material you upload to PowerHit, including footage of yourself or others practising or playing cricket.
• You retain ownership of your User Content. By uploading it, you grant PowerHit a worldwide, non-exclusive, royalty-free licence to store, process, and analyse that content using our AI systems in order to provide the Service, including generating technique scores, comparisons, and drill recommendations.
• If you choose to make a score, clip, or profile public (for example, on a leaderboard or shared to social media), you grant us permission to display that content within the Service in that public context.
• You confirm that you own or have the necessary rights to any video you upload, and that uploading it does not infringe another person's rights. If a video includes another identifiable person (for example, a training partner), you confirm you have their permission — or, if they are a minor, their parent or guardian's permission — to upload and analyse that footage.
• Do not upload content that is unlawful, infringing, or that features a minor in an inappropriate context. See Section 7 (Acceptable Use).

7. Acceptable Use

When using PowerHit, you agree not to:

• Upload content that is unlawful, harassing, defamatory, obscene, or that violates the rights of others;
• Upload any video or image that sexualises, endangers, or otherwise inappropriately depicts a minor;
• Impersonate another person or misrepresent your identity, age, or affiliation;
• Attempt to reverse-engineer, scrape, or interfere with the Service or its AI systems;
• Use the Service for any purpose that is fraudulent, abusive, or intended to manipulate leaderboards or technique scores;
• Violate any applicable law while using the Service.

We may suspend or remove content, or restrict or terminate accounts, that violate this section.

8. AI & Coaching Disclaimer

• Technique scores, comparisons, and drill recommendations are generated by an automated AI system and are intended for training and informational purposes only.
• PowerHit is not a substitute for guidance from a qualified, in-person cricket coach, physiotherapist, or medical professional. AI-generated feedback should be treated as a supplementary training aid, not professional medical, fitness, or coaching advice.
• Where the Service offers feedback from human coaches, that feedback reflects the individual coach's opinion and is not guaranteed to result in any particular outcome, including selection, ranking, or improvement.
• Always warm up appropriately and use good judgement — including stopping any drill or exercise that causes pain — when following recommendations from the Service.

9. Leaderboards & Public Profile

PowerHit may let you opt in to a public or semi-public player profile, showing your technique scores and city/state/national leaderboard ranking. Participation is optional. If you are under 18, we recommend involving a parent or guardian in the decision to make a profile public, and you should avoid including personally identifying details (such as your school, home address, or exact age) beyond what is needed to use the Service.

10. Intellectual Property

The PowerHit name, logo, app design, AI models, and underlying software are the property of PowerHit and its licensors and are protected by intellectual property laws. Nothing in these Terms grants you any right to use PowerHit's trademarks, branding, or proprietary technology outside of your normal use of the Service.

11. Third-Party Services & Comparison Data

Reference footage and technique benchmarks used for pro-player comparisons are sourced and used for analytical and educational comparison purposes. The Service may also rely on third-party infrastructure (such as cloud hosting and payment processing) to operate; use of the Service is also subject to the relevant app store's terms (Google Play, and, when available, the Apple App Store).

12. Termination

You may stop using the Service and delete your account at any time from within the app or by contacting help@powerhitapp.com. We may suspend or terminate your access if you violate these Terms, misuse the Service, or if required by law. Upon termination, your right to use the Service ends immediately; certain provisions of these Terms (including intellectual property, disclaimers, and limitation of liability) survive termination.

13. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We do not guarantee that technique scores or AI analysis will be error-free, or that use of the Service will lead to any specific improvement, selection, or result. To the fullest extent permitted by applicable law, PowerHit and its team will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service will be subject to the jurisdiction of the courts of India, unless otherwise required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify users through the app or via email, and update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
